Introduction

Welcome to Smart Leader Fit (“we,” “us,” “our”). These Terms & Conditions (“T&Cs”) govern your use of our website smartleaderfit.com (“Website”) and all coaching, workshops, assessments, and related services (collectively, “Services”). By accessing the Website, booking or attending any Service, you agree to be bound by these T&Cs.

1. Scope

These T&Cs apply to:

• All visitors and users of the Website.
• All clients and purchasers of one-time sessions, packages, or subscriptions.
• Any free or paid resources, workshops, or events we provide.

Any additional or conflicting terms proposed by you (e.g., in email signature blocks) are excluded unless we expressly agree in writing.

2. Services

Smart Leader Fit offers:

• One-on-one coaching sessions (in-person or virtual)
• Leadership assessments and 360° feedback
• Tailored development plans and goal‐setting roadmaps
• Group workshops on communication, decision‐making, and team dynamics
• Ongoing mentorship subscriptions and accountability check-ins

3. Booking & Contract Formation

No formal registration is required to browse our offerings. To book a Service:

1. Submit an inquiry via phone, email, or the Website form.
2. Receive a written confirmation (email) with Service details and invoice.
3. Once you confirm and any deposit is paid, a binding contract is formed under these T&Cs.

4. Payment & Terms

All fees are quoted in Swiss francs (CHF) and are payable by bank transfer or credit card:

• Kickstart Package: CHF 1 200, due within 14 days of invoice.
• Premium Package: CHF 2 800, due within 14 days of invoice; includes bi-weekly check-ins.
• Custom Package: Price upon request; terms specified in proposal.
• Late payments incur a 5% monthly interest and may result in service suspension.

5. Refund Policy

Your satisfaction is our priority. Refunds are granted as follows:

• Kickstart Package: Full refund if cancelled within 14 days of invoicing and before your first session.
• Premium Package: Full refund if cancelled within 7 days of invoicing and before any coaching begins; thereafter, no refund.
• Custom Package: 50% deposit refundable if you cancel within 7 days of proposal confirmation and before any work has started; thereafter, no refund.

To request a refund, email support@smartleaderfit.com with your invoice number and cancellation date.

6. Intellectual Property

All materials—slides, assessments, reports, text, graphics, and recordings—are our exclusive property or licensed to us. You receive a limited, non-exclusive license to use materials for your personal development. Any reproduction or distribution beyond private use requires our prior written consent.

7. Liability Disclaimer

Coaching and assessments are designed to support your growth but results vary. We do not guarantee specific outcomes. We are not liable for any indirect, incidental, or consequential damages arising from use of our Services. Our total liability is capped at the amount you paid for the Service in question.

8. Amendments & Duration

We may update these T&Cs at any time. We will notify you of material changes via email or Website announcement at least 14 days before they take effect. Your continued use of our Services after that date constitutes acceptance. Unless otherwise agreed, one-time Services conclude upon delivery; subscriptions remain in effect until cancelled.

9. Data Protection & Consent

We handle your personal data in accordance with our Privacy & Cookie Policy. By using our Website or Services, you consent to such processing.

10. Termination & Suspension

We may suspend or terminate Services if you materially breach these T&Cs (including non-payment) or applicable law. You may terminate recurring subscriptions with 30 days’ notice; any services rendered up to that point will be billed pro rata.

11. Governing Law & Dispute Resolution

Swiss law governs these T&Cs. In case of dispute, we agree first to seek mediation in Winterthur; if unresolved, courts of the Canton of Zurich (in German: Zürcher Obergericht) have exclusive jurisdiction.
